RATIONALE

The attached proposed policy revisions are recommended by the administration. 

 

BBFA   Conflict of Interests and Disclosure of Economic Interests

Policy updated to reflect amendment of Va. Code § 2.2-3119 by HB 212/SB 124.  For years, there have been two options for this policy because divisions were subject to different anti0nepotism rules based on the Planning District in which thy division was located.  Going forward, there will be only one version of this policy because statutory changes establish that all school boards will be subject to the same anti-nepotism rules. 

 

CBB     Appointment and Term of the Superintendent

Policy updated to reflect amendment of Va. Code § 22.1-60 by HB 81.  A school board that does not appoint a superintendent within 180 days of a vacancy may now request additional time, up to 180 days, within which to make the appointment.

 

CLA     Reporting Acts of Violence and Substance Abuse

Policy updated to reflect amendment of Va. Code § 22.1-279.3:1 by HB 292. 

 

DA       Management of Funds

            Policy updated to reflect content of Legal References.

 

DJ        Small Purchasing

Policy updated to reflect amendment of Va. Code § 2.2-4303 by HB 97.  Amount changed from $60,000 to $80,000 for small purchase contracts/professional services not requiring competitive negotiation.

 

GA       Personnel Policies Goals

Legal References updated to reflect enactment of Acts 2018, c. 513 by HB 438/SB 605.

 

GBB     Prohibition of Abusive Work Environments

New policy to reflect enactment of Va. Code § 22.1-291.4 by HB 1044. This is a new policy prohibiting abusive work environments in the school division.  Retaliation against employees who make allegations of abusive work environments is also prohibited.

 

GC       Professional Staff

Policy updated to reflect amendment of Va. Code § 22.1-299 by HB 1125/SB 349.  Permits superintendent to request extension of provisional license.

 

GCCB  Employment of Family Members

           Option 1                      

           Policy updated to reflect amendment of Va. Code § 2.2-3119 by HB    

           212/SB 124.  Family members of board members may be employed  
           under certain guidelines. 

 

GCDA  Effect of Criminal Conviction or Founded Complaint of Child

             Abuse or Neglect

             Policy updated to reflect enactment of Acts 2018 c. 833 by HB

             1000.  Provides guidelines for the School Board to employ

             individuals who have been convicted of a felony.

 

GCG    Professional Staff Probationary Term and Continuing Contract

            Policy updated to remove references to local teaching licenses.

 

GDD-R Teacher Assistant – Employment Qualifications

             Clarifies all teacher assistants must attain one of the three

             qualifications by June 30 of the employment year.

 

IA         Instructional Goals and Objectives

Policy updated to reflect amendment of Va. Code § 22.1-253.13:1 by HB 399 (re item # 15) and HB 507 (re item # 12).

 

IC/ID    School Year/School Day

Policy updated to reflect enactment of Acts 2018, c. 785 by HB 1419/SB 273 and changes to the Standards of Accreditation. Legal References and Cross References updated.  The language on the first page reflects the revised state statute which goes into effect July 1, 2018.  This allows recess to be included in instructional time calculations for grades K-5.  The language on the second page which excludes recess from instruction time calculations is current VDOE regulation.  This language has not yet been revised to reflect statutory changes. 

 

IGAD    Career and Technical Education

Policy updated to reflect amendment of Va. Code § 22.1-227.1 by HB 544/SB9 60.  Permits work partnerships for high school students.

First paragraph of policy updated to reflect amendment of Va. Code § 22.1-207 by HB 1604/SB 953 and by HB 1532.

IJD       College and Career Readiness

New Policy reflecting new provisions in the revised Standards of Accreditation and amendment to Va. Code § 22.1-253.13:1 by HB 632.  This is a new policy which addresses academic and career plan portfolios (ACPPs) and academic and career plans (ACPs).  It is based on amendments to both law and BOE regulations revised as part of Profile of a Virginia Graduate. 

 

IKEB    Acceleration

             Policy and Legal Reference updated to reflect changes to the

             Standards of Accreditation.

 

IKFA    Locally Awarded Verified Credits

             Policy updated to reflect amendments to the Standards of

             Accreditation and new guidance from the Department of

             Education.  The rules regarding Locally Awarded Verified Credits    

             were changed as part of the changes to the Standards of

             Accreditation which took effect in January and then changed again

             pursuant to Emergency Regulations adopted by the BOE which

             took effect in May. 

 

IKFA-F Locally Awarded Verified Credit Appeal Application

             Form revised to reflect change made in Policy IKFA.

 

IKG      Remediation Recovery Program

             Policy and Legal References updated to reflect amendments to the

             Standards of Accreditation.

 

IKH      Retaking SOL Assessments

Policy updated to reflect adoption of Revisions to the Criteria for the Determination of Student Eligibility for Expedited Retakes of Standards of Learning (SOL) Tests, Virginia Board of Education, March 22, 2018.  The BOE has changed the rules governing when students qualify for expedited retakes of SOL tests.  The standards for qualification now depend on the reason for retaking the test.  Different rules apply to students who retake the tests for federal accountability purposes than for students who retake the tests to earn verified credits.

 

IL         Testing Programs

Policy updated to reflect amendment of Va. Code § 22.1-4.2 by SB 238.   Clarifies elementary students are not required to disclose race or ethnicity on tests or assessment instruments. 

 

JC        Student Attendance Areas

Policy updated to reflect enactment of Va. Code § 22.1-7.2 by HB 1085.  Students who live in military housing or on military installations now have the option to enroll in any school in the division if space if available.  The superintendent is responsible for establishing an application process for requests.

 

JEA      Compulsory Attendance

             Policy updated to reflect amendment of Va. Code § 22.1-254 by

             HB 829 and amendment of Va. Code § 22.1-277.2:1 by SB 170.

 

JEC      School Admission

Policy updated to reflect amendment of Va. Code § 22.1-254 by SB 775.

 

JECA   Admission of Homeless Children

Policy updated to reflect amendments to Va. Code § 22.1-3 by SB 961.  The definition of “homeless” children in Virginia law has been updated to correspond with the definition in federal law. 

 

JED      Student Absences/Excuses/Dismissals

Policy updated to reflect amendment of Standards of Accreditation and amendment of Va. Code § 22.1-258 by HB 1485/SB841.

 

JED-R  Guidelines for School and Class Attendance

             Text deleted regarding tardies and/or early releases at the high   

              school level.

 

JGD     Student Suspension/Expulsion

             Policy updated to reflect amendment of Va. Code § 22.1-279.3:1    

             by HB 292, b 292HBamendment of Va. Code §§ 22.1-276.01 and 22.1-

             277.05 by HB 1600 and amendment of Va. Code §§ 22.1-277 and

             22.1-277.2:1 by SB 170.  The revision policy reflects several    

             changes to student discipline rules.  Long-term suspensions may

             not last more than 45 school days except in specified situations.   

             In addition, students in preschool through third grade may not be

             suspended for more than three school days, or expelled, except in

             specified circumstances.  The VDOE is required to define some of

             the aggravating circumstances which will support disciplinary

             action. 

 

JO        Student Records

Policy and Legal References updated to reflect amendment of Va. Code § 22.1-287.1 by HB 1 and § 2.2-3705.4 by SB 512.  Schools may not release the address, phone number or email address of students as directory information or pursuant to the Virginia Freedom of Information Act unless the parent or eligible student gives written consent for the release.
