The Family Educational Rights and Privacy Act (FERPA), a federal law, requires that Alleghany County Public Schools, with certain exceptions, obtain the parent’s written consent prior to the disclosure of personally identifiable information from the child’s educational records.  However, Alleghany County Public Schools may disclose appropriately designated “directory information” without written consent, unless the parent has advised the school to the contrary.  The primary purpose of directory information is to allow Alleghany County Public Schools to include this type information from the student’s educational records in certain school related publications.

Directory information, which is information that is generally not considered harmful or an invasion of privacy if released, can also be disclosed to outside organizations without a parent’s prior written consent.  Outside organizations include, but are not limited to, companies that manufacture class rings or publish yearbooks.  In addition, federal law requires Alleghany County Public Schools to provide military recruiters, upon request, names, addresses, and telephone listings, unless the parent has provided written notice that they do not want their child’s information disclosed.

If a parent does not want Alleghany County Public Schools to disclose directory information from the child’s educational records without prior written consent, the parent must notify the school principal in writing at the beginning of each school year.

No school disclosed the address, telephone number, or email address of a student pursuant to 34 C.F.R. § 99.31(a)(11) or the Virginia Freedom of Information Act unless the parent or eligible student affirmatively consents in writing to such disclosure.
