NONDISCRIMINATION ON THE BASIS OF DISABILITY

 

Section 504 of the Rehabilitation Act of 1973 and its accompanying regulations apply to all school divisions receiving federal funds.  Under the Act a school division:

  1. May not discriminate against qualified disabled persons in any aspect of school division employment solely on the basis of disability.
  2. Must provide facilities, programs, and activities that are accessible, usable, and available to qualified disabled persons.
  3. Must provide free appropriate education at elementary and secondary levels, including nonacademic and extracurricular services and activities, to qualified disabled persons.
  4. May not exclude any qualified disabled person solely on the basis of disability from participation in any preschool education or day care programs or activity or any adult education or vocational program or activity.
  5. May not discriminate against qualified disabled persons in the provision of health, welfare, and other social services.

The School Board will designate an individual to act as the division’s compliance officer

under the provisions of section 504 of the Rehabilitation Act.  All students and employees will be notified annually of the name, office address and telephone number of the designee.
